Terms of Sale

 

  1. INTEGRITY:

    1. Epicure Farms (EF) does not use a sales agreement or contract but relies on the integrity of the customer to pay their invoices on time.  In turn, EF will provide our product how the customer would expect to receive it. 

  2. PRODUCT:

    1. EF sells fresh cut products that have been hand processed in a USDA approved facility.  EF products have been grown to USDA standards but, because of their fresh nature they cannot be not sanitized, pasteurized or sterilized without destroying the product itself.  The product has been properly cleaned and is ready to eat much like lettuce or any other freshly grown product. It is recommended the product be fresh water rinsed prior to preparation.

  3. PAYMENT:

    1. Payment is expected within 21 days of invoice receipt.

    2. Payment may be made by check or credit card.

    1. ADVISEMENT: Payments made to the defunct Epicure Select or any of its addresses cannot be cashed or used by this company.  EF has no connection with this company; it has been taken over by their bank and that bank will not refund your money nor give it to us. We have never been part of or connected with that company.

  1. CREDIT:

    1. All first time orders will be place with a sales limit of $300.00.  If the bill is paid within the allotted 21 days two periods in a row, the order limit will be increased to an average ordering amount.

    2. Credit card orders may order to the limit of the cards capability.

  2. ORDERS:

    1. Orders may be placed at any time by calling or emailing your sales representative.  Orders may also be placed over the Internet.  It is best to call the office during normal business hours of 0800 to 1630 hrs PST so to get your order in a timely fashion.

  3. SAMPLES:

    1. We are happy to provide samples without charge on any of our products so long as the sample is packed with a normal delivery to your company. This saves you the cost of separate postage for the sample.

    2. We will respectfully ask for shipping costs for those samples provided separately of orders.

    3. First time customers, there is no cost for the sample or postage.

  4. PROBLEMS:

    1. Basically, if there is a problem with your order and we are notified of this problem within 24 hours of delivery, we will correct the problem through replacement of the order, credit, or other suitable resolution.

    2. If the problem is more than 24 hour old, please still notify us as soon as possible of the issue and we will do our best to rectify it with a suitable resolution given the circumstances and the amount of time that has passed since the order was placed.

    3. If there is any problem with the product or the bag is bloated, torn, damaged in any way, please dispose of the product immediately so it is not accidentally served and consumed.  Please call us immediately to get a replacement order.

  5. COMMUNICATION:

    1. Please notify us in two ways of a problem whether or not it is within 24 hours by telephone and email.

  6. SHELF LIFE:

    1. The shelf life of our product is 7 to 14 days; more than 14 days is common and depends completely on the temperature of the product; less than 38 degrees continuously is absolutely recommended.  (Please see our handling recommendations below.) If you prefer a longer shelf life please let us know so that we can prepare the product or container for a longer period of time.  This shelf life estimate is nationwide.

    2. Frozen product is often available with pre-coordination given the commodity.

  7. HANDLING: 

    1. Immediately upon receiving the order please open the shipping box and place the bagged product directly into a cooler or freezer.  Do not expose it to the sun; do not open the bag until ready-to-use or otherwise over-handle the product.  This is a handling-sensitive-fresh-product – do not let it warm up for any period of time. Please keep it cold.

    2. The product may be used directly from the container.  It is an uncooked product.

    3. Flushing with Lime Juice and then rinsing with fresh water to remove any remaining lime taste may brighten product that has become discolored. Containers may be resealed with the unused product.

  8. FOOD SAFETY:

    1. This product was processed under the strictest of USDA food safety standards, in a USDA plant and audited quarterly by the USDA. 

    2. It is food safe within the bag so long as the seal is intact (unless the bag is bloated from heat – some bags will loosen up with time or handling and this is not an issue). The product should be handled with washed or gloved hands.

  9. OTHER TERMS:

    1. Sales Rules: (All PST)

                                                               i.      Normal orders are shipped within 3 days if received before 10:00 AM. (Example, order received before 10:00 AM on Monday is shipped no later than Thursday.) (If the order can go out the same day or next day it will be shipped)

                                                              ii.      Normal orders received after 10:00 AM are shipped as if placed the next day. (Example, order received at 10:30 AM on Monday is put into the queue for Tuesday and shipped in three days – the order would be shipped no later than Friday.)  If the order can ship earlier it will.

                                                            iii.      Special Orders for two-day shipment shipped within 2 days if received before 10:00 AM. (Example, order received before 10:00 AM on Monday is shipped no later than Wednesday.) A 5% surcharge is added to the order. (If the order can go out the same day or next day with no disruption of production it will be shipped and with no extra fee.)

                                                            iv.      Special Orders for two-day shipment shipped within two-days if received after 10:00 AM are shipped as if received the next day. (Example, order received at 10:30 AM on Monday is put into the queue for Tuesday and shipped in two days – the order would be shipped no later than Thursday.) Again, a 5% surcharge is added to the order. (If the order can go out the same day or next day with no disruption of production it will be shipped and with no extra fee.)

                                                             v.      Priority Orders for next day shipment if received before 10:00 AM. (Example, order received before 10:00 AM on Monday is shipped no later than Wednesday.) A 10% surcharge is added to the order. (If the order can go out the same day or next day with no disruption of production it will be shipped and with no extra fee.)

                                                            vi.      High Priority Orders for same day shipment if received before 10:00 AM. (Example, order received before 10:00 AM on Monday is shipped no later than Monday afternoon.) A 15% surcharge is added to the order. (If the order can go out the same day or next day with no disruption of production it will be shipped and with no extra fee.)
